In the event of a claim, whether it’s a traffic accident, theft, or vandalism, the claim process is similar; if you have suffered a theft, serious collision, vandalism, or a hit-and-run, you should request a police report.

In the event of a car accident in Canada, there are certain steps that must be followed to file a claim with the insurance company and receive compensation.

Step 1: At the scene of the accident
If the accident is minor, meaning there are no injured persons, the first thing to do is fill out a form known as the “Constat amiable.” If you don’t have one on hand, you must exchange information with the other driver, including name, address, phone number, driver’s license number, vehicle registration number, and insurance details. It is highly recommended to fill out and sign the “Constat amiable,” as one of the drivers may change their statement when reporting the incident.

If the accident involves injuries, it is important to quickly contact emergency services and, in case of an accident with an unoccupied vehicle or more than three vehicles involved, call the police to report the incident.

Step 2: Filing the claim
Once in contact with your insurer or insurance broker, a claims expert will be assigned to your case. This person will investigate the validity and coverages included in your auto insurance policy, determine your liability in the accident, and guide you through the steps to follow.

The maximum time for the insurance company to compensate you is 60 days from filing the claim or receipt of the supporting documents. In case of theft, it is common for the insurer to wait 30 days before making the payment in case the vehicle is recovered.

If your vehicle has been stolen and you have purchased theft protection in your insurance policy, you may receive compensation from your insurer. It is important to note that the deductible amount you have chosen in your contract will be deducted.

If your stolen vehicle is found with damage, most insurers will proceed with repairs. If items have been stolen from your vehicle, it is important to provide your insurer with a detailed list of the objects that were inside: If they are vehicle accessories, they will be covered by your car insurance; if they are other items, such as a computer, glasses, or suitcases, they will be covered by your home insurance, if you have one.

In case of a hit-and-run, meaning you have suffered damage caused by someone who left the scene without identifying themselves, you may receive compensation from your insurer if you have purchased damage protection in your insurance policy (such as “all risks” or “specific risks” coverage).

Step 3: Damage assessment
The damage assessment is a crucial step in the claim process, as it determines the cost of repairs and whether the vehicle can be repaired or is considered a total loss. If the vehicle is declared a total loss, the insurer will replace your vehicle or compensate you based on the vehicle’s value (value at the time of the loss or new value).

Step 4: Vehicle repair
After the damage assessment has been completed, the vehicle will be taken to the repair shop chosen by the insured or recommended by the insurer. It is important to ensure that the work is done according to the budget agreed upon with the insurance company.

Regarding the parts used, new or recycled parts will be used as stipulated in the policy. Basic car insurance policies usually cover repair with original manufacturer recycled parts. If you want new parts, you must have additional coverage in the policy, such as “New Value” or replacement insurance.
